Privacy Policy and SMS Terms

Scope

This policy applies to tkyholdings.com, the resident portal at portal.tkyholdings.com, and any SMS messages you receive from TKY Holdings. It does not modify a signed lease or other written agreement between you and TKY Holdings LLC; in the event of a conflict, the signed agreement controls.

Information we collect

Website and contact: when you use our contact form we receive the fields you submit (name, email, phone, inquiry type, and message). We use Vercel Analytics, which captures anonymous, aggregated page-view data without cookies.

Rental, lease, payment, and maintenance:to administer a tenancy we collect the information necessary to do so — your name and contact details, rental or tenancy history, lease documents, maintenance requests, and payment references. Rent payments are processed through our bank's ACH system or through Zelle; TKY Holdings does not store full bank credentials or card numbers.

SMS: when you opt in to our text messages, we collect your mobile number, the method and timestamp of your opt-in, and the message metadata and content necessary to send and receive messages (for example, delivery status and your replies).

How we use information

We use the information above to respond to your inquiries, administer your lease, send transactional and property-related SMS to people who have opted in, meet our legal and record-keeping obligations, and operate and secure our site and portal. We do not sell your information.

Disclosures and service providers

We share information only with the service providers we rely on to run the business, and only to the extent they need it to provide their service. These include our website host, our email service provider, our managed database provider, our SMS provider, and the bank or ACH processor that handles rent payments. We do not sell, rent, or trade your information.

We may also disclose information when required by law — for example, in response to a subpoena, court order, or other lawful request — or where we believe disclosure is necessary to protect the rights, property, or safety of TKY Holdings, our residents, or others.

Mobile information and SMS consent

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Mobile phone numbers, SMS opt-in data, and messaging consent will not be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. Information that you share with us in the course of the SMS program is used only to operate that program and to provide the services you have requested. Sharing with subprocessors that support the SMS program (for example, our SMS platform) is limited to what is required to deliver messages.

Cookies and analytics

We do not use advertising cookies. Vercel Analytics is cookieless and reports only aggregated, anonymous page-view data. Your browser may still use standard cookies for its own functions (for example, remembering login state on the resident portal).

Retention and security

Our site and portal are served over HTTPS. Data is encrypted in transit and at rest in our managed database. We keep information only as long as we need it for the purposes above or as required by law — most notably, Arizona landlord-tenant record-keeping requirements, which govern how long tenancy records must be retained.

Your privacy choices

Email info@tkyholdings.com to request access to, correction of, or deletion of your information, subject to statutory record-keeping requirements. You can also ask us to stop contacting you at any time; for SMS, follow the opt-out instructions below.

SMS terms

Program purpose. TKY Holdings uses SMS to send property, lease, payment, and maintenance communications to residents, applicants, and other people who have asked to hear from us. Message content is limited to the purposes described in the opt-in that you agreed to.

Consent. By opting in you consent to receive SMS from TKY Holdings at the mobile number you provide. Consent is not a condition of purchase, tenancy, or any other transaction. You may opt out at any time; opting out does not affect your lease, your application, or any other relationship with us.

Frequency. Message frequency varies based on your account activity and the nature of the communication (for example, a maintenance thread may generate several messages in a short period, while payment reminders are less frequent).

Message and data rates. Message and data rates may apply. Check the plan you have with your mobile carrier.

Opt out. Reply STOP at any time to opt out of the SMS program. After you reply STOP we will send a confirmation and will not send you further program messages. To rejoin, opt in again through the same channel you used originally.

Help. Reply HELP for help, or contact us at info@tkyholdings.com. We will respond during normal business hours.

Carriers. Mobile carriers are not liable for delayed or undelivered messages.

Accurate number. You agree to provide a mobile number that you control and to notify us if your number changes or is reassigned so that our messages do not reach an unintended recipient.

Acceptable use. You agree not to use the SMS program for any unlawful, abusive, harassing, or unsolicited purpose, and not to impersonate any person or misrepresent your affiliation with any person.

Website terms

This website is provided for informational purposes. We work to keep it accurate and current, but we do not guarantee that information here is complete, error-free, or continuously available. Third-party links are provided for convenience; we are not responsible for the content or practices of sites we link to. Where anything on this site conflicts with a signed lease or other written agreement between you and TKY Holdings LLC, the signed agreement controls.

Changes to this policy

We may update this policy from time to time. When we make material changes we will note them on this page and update the effective date above. Your continued use of the site, portal, or SMS program after the effective date constitutes acceptance of the updated policy.
